terms of service

welcome to mrigAI. these terms of service ("terms") govern your use of the mrigAI mobile application (the "app") operated by mrigAI ("we", "our", or "us").

by downloading, installing, or using the app, you agree to be bound by these terms. if you do not agree to these terms, do not use the app.

1. description of service

mrigAI is a shopping assistant app that offers two main product lines:

• quick-commerce price comparison: compare prices across multiple quick-commerce platforms (zepto, blinkit, swiggy instamart), view your shopping cart across different platforms, and make informed purchasing decisions
• virtual try-on for fashion: browse fashion e-commerce sites in our in-app browser and use AI-powered virtual try-on to visualize how clothing items might look on you before purchase

the app acts as an assistant tool and does not sell products directly.

2. user consent and authorization

2.1 explicit permission and data access

by accepting these terms and using the app, you explicitly and voluntarily grant mrigAI permission to:

session and authentication access

• access your logged-in sessions: use your authenticated sessions on zepto, blinkit, and swiggy instamart platforms
• session and network context: observe network requests/responses within the embedded browser to obtain session identifiers and api headers required for features you invoke
• access localstorage: read and write to browser localstorage to retrieve your account data, cart contents, and session information
• access cookies: read platform cookies to obtain store ids, session tokens, and serviceability information

data extraction authorization

you authorize mrigAI to extract and store the following data from each platform. this data may be processed and stored locally on your device to enable app functionality; certain limited account metadata may also be transmitted to and stored on our backend to support the app experience across sessions.

from zepto:

• mobile number, user profile, delivery addresses, location coordinates
• device id, session id, store id, csrf tokens, and api headers
• shopping cart contents and pricing information

from blinkit:

• phone number, user profile, user id
• search history, saved locations, delivery addresses
• shopping cart contents and pricing information

from swiggy instamart:

• mobile number, user profile from platform state
• delivery location and address information
• shopping cart contents and pricing information

unless otherwise stated in these terms, sensitive session artifacts (such as authentication tokens, api headers, and session identifiers required to call platform apis) are handled and stored on your device to enable app functionality.

automation authorization

you authorize mrigAI to perform the following automated actions on your behalf:

• product searches: execute search queries using your authenticated session to find products
• cart operations: read cart contents, add items to cart, modify quantities, and sync carts across platforms
• price retrieval: fetch current prices using your location and session data
• api calls: make direct api calls to platform servers using captured authentication headers

2.2 acknowledgment of data collection methods

you understand and acknowledge that mrigAI:

• injects javascript code into platform webpages to intercept data
• monitors network requests to capture api responses
• stores captured session data on your device to enable functionality across app sessions
• may access data that platforms consider private or session-specific

2.3 your responsibility

you acknowledge and agree that:

• you are the rightful owner of the platform accounts you log into
• you have the legal right to authorize third-party access to your account data
• you are responsible for maintaining the security of your platform accounts
• any actions performed through the app using your logged-in sessions are authorized by you
• third-party platforms may restrict or prohibit certain forms of automated access, data extraction, or scripting under their own terms, policies, or technical controls
• you accept full responsibility for your decision to use this app and its features
• you will not hold mrigAI liable for any consequences arising from platform policy violations

2.4 user-directed automation (authorization as your agent)

you understand and agree that:

• the app performs automation only to the extent you choose to use its features (e.g., search, cart read/sync, price retrieval) and only in relation to accounts you authenticate into.
• you are instructing the app to act as a tool/agent on your behalf when you use automation features.
• you can revoke authorization at any time by logging out of the underlying platform(s), clearing app data, and/or uninstalling the app.

2.5 records of consent and authorization

you agree that we may keep records of your acceptance of these terms and our privacy policy (including timestamps and version/date), and records of feature-related consents, to demonstrate your authorization and to help prevent fraud and abuse.

2a. virtual try-on feature

our virtual try-on feature uses AI to generate approximations of how clothing items might look when worn. important disclaimers:

• ai-generated approximations: try-on results are AI-generated visualizations and may be inaccurate regarding fit, drape, color, texture, or other product characteristics
• not a guarantee: virtual try-on outputs do not guarantee how products will actually look or fit on you
• verify on merchant site: you must verify all product details, sizing, specifications, and policies on the merchant's website before making any purchase
• your responsibility: purchasing decisions are your sole responsibility; we are not liable for dissatisfaction with actual products based on virtual try-on results

2b. in-app webview and dom injection

our app includes an in-app browser that allows you to browse fashion e-commerce websites. when you use this feature:

2b.1 ui element injection

• the app may inject UI elements (such as a "try on" button) into product pages displayed in the in-app browser
• the app may extract product image information and metadata needed to provide virtual try-on functionality
• the app may update the page display, including swapping product image src attributes with generated try-on output URLs to show your personalized try-on results

2b.2 no affiliation

mrigAI is not affiliated with, endorsed by, or officially connected with any third-party fashion merchants or e-commerce platforms unless explicitly stated otherwise.

2b.3 technical limitations

changes to website layouts, structures, or technical implementations by third-party merchants may cause try-on features or DOM injection to malfunction or become unavailable. we do not guarantee compatibility with all websites or continued functionality.

2c. user content and license grant

when you use virtual try-on features, you grant mrigAI the following rights:

• limited license: you grant us a limited, non-exclusive, royalty-free license to process your selfies and the product images you select solely to generate try-on outputs and operate the service
• your content ownership: you retain all ownership rights to photos and images you provide
• your responsibility: you represent and warrant that you have all necessary rights to any content you provide, including selfies and any other images
• prohibited content: you must not upload photos of other people without their explicit permission, or any illegal, offensive, or inappropriate content

3. third-party platforms

3.1 independent services

zepto, blinkit, and swiggy instamart are independent third-party services. we are not affiliated with, endorsed by, or officially connected with any of these platforms.

3.2 platform terms

your use of these platforms through our app is also subject to their respective terms of service and privacy policies. it is your responsibility to review and comply with their terms.

3.3 no guarantee

we do not guarantee:

• accuracy of prices displayed (prices may change in real-time)
• availability of products across platforms
• successful completion of any transaction on third-party platforms
• uninterrupted access to third-party platform features

3.4 third-party purchases and transactions

all purchases occur directly on third-party merchant websites. mrigAI is not responsible for:

• order processing, fulfillment, shipping, or delivery
• product quality, accuracy of descriptions, or merchant representations
• returns, refunds, exchanges, or customer service issues
• merchant policies, pricing changes, or inventory availability
• any disputes between you and third-party merchants

for any issues with orders or products, contact the merchant directly.

3.5 website changes and compatibility

third-party websites may change their layout, structure, or technical implementation at any time. such changes may break or limit virtual try-on functionality, DOM injection features, or product information extraction. we are not liable for loss of functionality due to third-party website changes.

4. acceptable use

you agree not to:

• use the app for any illegal or unauthorized purpose
• attempt to gain unauthorized access to any platform or system
• use automated scripts or bots beyond the app's intended functionality
• use the app to bypass, defeat, or circumvent security measures of any third-party platform (including access controls, authentication, captchas, rate-limits, or other technical protections)
• interfere with or disrupt the app or connected services
• reverse engineer, decompile, or disassemble the app
• use the app to harm, harass, or defraud others
• share your access to the app with others for commercial purposes
• regarding virtual try-on: upload photos of other people without their explicit permission
• upload illegal, offensive, inappropriate, or deceptive content
• use generated try-on outputs for illegal, deceptive, or harmful purposes
• misrepresent AI-generated try-on images as actual product photos or authentic representations

5. intellectual property

5.1 our property

the app, including its design, features, code, and content, is owned by mrigAI and protected by intellectual property laws. you may not copy, modify, distribute, or create derivative works without our written permission.

5.2 third-party content

product images, descriptions, and prices displayed in the app belong to their respective platforms and are shown for comparison purposes only.

6. disclaimer of warranties

the app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• merchantability
• fitness for a particular purpose
• non-infringement
• accuracy of information

we do not warrant that:

• the app will be uninterrupted or error-free
• defects will be corrected
• the app is free of viruses or harmful components
• price comparisons will always be accurate or up-to-date

7. limitation of liability

to the maximum extent permitted by law, mrigAI shall not be liable for:

• any indirect, incidental, special, consequential, or punitive damages
• loss of profits, data, or goodwill
• any damages arising from your use of third-party platforms
• any transactions or purchases made on third-party platforms
• price discrepancies between what is shown in the app and actual platform prices

your use of the app is at your sole risk.

8. indemnification

you agree to indemnify and hold harmless mrigAI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• your use of the app
• your violation of these terms
• your violation of any third-party rights
• any actions performed on third-party platforms using your sessions
• any claims by zepto, blinkit, swiggy, or any other platform regarding your use of this app
• any account suspension, termination, or restriction imposed by platforms due to your use of this app

8a. waiver and release regarding third-party platforms

8a.1 voluntary use

you acknowledge that your use of mrigAI to access zepto, blinkit, and swiggy instamart is entirely voluntary. you have chosen to use this app with full knowledge of how it operates.

8a.2 release of claims

you hereby release, waive, and forever discharge mrigAI from any and all claims, demands, damages, actions, or causes of action arising from:

• any action taken by zepto, blinkit, swiggy, or any platform against your account
• any loss of access to platform services
• any legal action initiated by platforms against you
• any financial losses resulting from platform actions
• any data breach or unauthorized access claims by platforms

8a.3 assumption of risk

you expressly assume all risks associated with:

• using automated tools to access platform services
• allowing third-party apps to access your platform sessions
• potential violation of platform terms of service
• possible account restrictions or terminations by platforms

8a.4 no guarantee of platform compatibility

mrigAI makes no guarantee that:

• platforms will permit the use of this app
• your platform accounts will remain active while using this app
• platform features will continue to work with this app
• platforms will not take adverse action against users of this app

8b. fees and payment

mrigAI may offer virtual try-on and other features through various pricing models:

• certain features may be available with free credits or usage limits
• paid subscription plans or pay-per-use options may be introduced
• pricing details, credit allocations, and plan features will be disclosed within the app
• we reserve the right to modify pricing and plans with reasonable notice

quick-commerce price comparison features are currently provided at no charge.

9. termination

9.1 by you

you may stop using the app at any time by uninstalling it from your device.

9.2 by us

we reserve the right to suspend or terminate your access to the app at any time, without notice, for any reason, including violation of these terms.

9.3 effect of termination

upon termination, your right to use the app ceases immediately. provisions that by their nature should survive termination will survive (including disclaimers, limitations of liability, and indemnification).

10. changes to terms

we may modify these terms at any time. we will notify you of significant changes by updating the "last updated" date. your continued use of the app after changes constitutes acceptance of the modified terms.

11. governing law

these terms shall be governed by and construed in accordance with the laws of india, without regard to conflict of law principles.

12. dispute resolution

any disputes arising from these terms or your use of the app shall be resolved through:

1. informal resolution: contact us first at aniket@mrigai.com to attempt to resolve the dispute informally
2. arbitration: if informal resolution fails, disputes shall be settled by binding arbitration in accordance with applicable indian arbitration laws

13. severability

if any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. entire agreement

these terms, together with our privacy policy, constitute the entire agreement between you and mrigAI regarding the app.
