terms of service

welcome to mrigai. these terms of service ("terms") govern your use of the mrigai mobile application (the "app") operated by mrigai ("we", "our", or "us").

by downloading, installing, or using the app, you agree to be bound by these terms. if you do not agree to these terms, do not use the app.

1. description of service

mrigai is an ai-powered virtual try-on app that lets you:

• browse fashion e-commerce sites: shop websites like myntra, zara, h&m, nike, and others in our in-app browser
• virtual try-on: use ai-powered virtual try-on to visualize how clothing items might look on you before purchase. this feature is powered by google's gemini ai, which processes your selfie photos and product images to generate try-on visualizations
• ai chat assistant: get styling recommendations and store suggestions through an ai-powered chat assistant, powered by google gemini with google search grounding

the app acts as a shopping assistant tool and does not sell products directly. all purchases happen on third-party merchant websites through the in-app browser.

2. user consent and authorization

2.1 ai data processing consent (google gemini)

mrigai uses google's gemini ai service to power its core features. by using the app and providing consent, you explicitly agree to the following:

• selfie photo sharing with google gemini: the selfie photos you upload (1–3 photos during onboarding) are sent to google's gemini api for processing. gemini uses these photos to generate virtual try-on images and to create a text description of your appearance.
• product image sharing with google gemini: product images extracted from merchant websites you browse in the in-app browser are sent to google gemini alongside your selfie photos to generate the try-on visualization.
• chat message processing by google gemini: messages you send to the ai chat assistant are processed by google gemini to generate responses. the ai chat may use google search grounding to provide up-to-date product and store information.
• video generation by google gemini (experimental): in experimental features, your selfie photos and product images may be sent to google gemini to generate short try-on video clips.
• cloud storage on amazon s3: your selfie photos and generated try-on outputs (images and videos) are stored on our servers (amazon s3) and delivered via amazon cloudfront cdn to enable the service.
• google's terms apply: data sent to google gemini is processed according to google's gemini api terms of service and google's privacy policy. we do not control how google processes, stores, or retains data sent through the gemini api.

2.2 in-app consent mechanism

before any of your data is sent to google gemini or other third-party services for the first time:

• the app presents a clear, prominent consent dialog disclosing that your selfie photos and product images will be sent to google's gemini ai for processing
• the consent dialog includes links to this terms of service and our privacy policy
• you must tap "i agree & continue" to proceed. sign-in will not complete until you provide this consent
• if you do not consent, no data will be sent to google gemini or any other third-party ai service
• your consent decision and timestamp are stored locally on your device

2.3 account and authentication

you may sign in using google or apple sign-in, managed by clerk. by signing in, you authorize clerk to share your name and email address with us for account management purposes. we do not collect or store your google or apple account password.

2.4 your responsibility

you acknowledge and agree that:

• you are responsible for the photos you upload and the content you provide
• you must only upload photos of yourself or photos you have explicit permission to use
• you understand that your selfie photos will be sent to google gemini for ai processing as described above
• purchasing decisions are your sole responsibility
• you accept that ai-generated results are approximations and may not accurately represent how products will look in real life

3. virtual try-on feature

our virtual try-on feature uses google gemini ai to generate approximations of how clothing items might look when worn. the process works as follows:

• your selfie photos and the product image are sent to google gemini via their api
• gemini generates an image of you wearing the selected clothing item
• the generated image is stored on amazon s3 and delivered to the app via amazon cloudfront cdn
• the result is displayed within the app and in the in-app browser product page

4. in-app browser and dom injection

our app includes an in-app browser that allows you to browse fashion e-commerce websites. when you use this feature:

4.1 ui element injection

• the app may inject ui elements (such as a "try on" button) into product pages displayed in the in-app browser
• the app may extract product image information and metadata needed to provide virtual try-on functionality
• the app may update the page display, including swapping product images with generated try-on results

4.2 third-party website data and cookies

when you browse merchant websites in the in-app browser:

• those websites may set their own cookies, use tracking pixels, run analytics scripts, and employ other data collection technologies
• any data collected by merchant websites through their own cookies and trackers is governed by those merchants' privacy policies, not ours
• cookies from merchant websites are stored locally on your device within the app's sandboxed storage and are deleted when you clear app data or uninstall the app
• mrigai collects the urls you visit and product page metadata as needed to provide the try-on service. this browsing data is not shared with google gemini
• mrigai does not require, collect, or store your login credentials for any merchant website. any logins to merchant sites happen directly on those sites

4.3 no affiliation

mrigai is not affiliated with, endorsed by, or officially connected with any third-party fashion merchants or e-commerce platforms unless explicitly stated otherwise.

4.4 technical limitations

changes to website layouts or technical implementations by third-party merchants may cause try-on features to malfunction or become unavailable. we do not guarantee compatibility with all websites or continued functionality.

5. data sharing with third parties

to operate the mrigai service, your data is shared with the following third-party services:

6. user content and license grant

when you use virtual try-on features, you grant mrigai the following rights:

• limited license: you grant us a limited, non-exclusive, royalty-free license to process your selfies and the product images you select solely to generate try-on outputs and operate the service
• ai processing authorization: you authorize us to send your selfie photos, product images, and chat messages to google gemini for ai processing as described in section 2.1
• cloud storage authorization: you authorize us to store your selfie photos and generated try-on outputs on amazon s3 and deliver them via amazon cloudfront
• your content ownership: you retain all ownership rights to photos and images you provide
• your responsibility: you represent and warrant that you have all necessary rights to any content you provide
• prohibited content: you must not upload photos of other people without their explicit permission, or any illegal, offensive, or inappropriate content

7. third-party platforms and purchases

7.1 merchant websites

the app provides access to third-party fashion e-commerce websites through the in-app browser. all purchases occur directly on those merchant websites.

7.2 not responsible for purchases

mrigai is not responsible for:

• order processing, fulfillment, shipping, or delivery
• product quality, accuracy of descriptions, or merchant representations
• returns, refunds, exchanges, or customer service issues
• any disputes between you and third-party merchants

for any issues with orders or products, contact the merchant directly.

7.3 website changes

third-party websites may change at any time. such changes may break or limit virtual try-on functionality. we are not liable for loss of functionality due to third-party website changes.

8. acceptable use

you agree not to:

• use the app for any illegal or unauthorized purpose
• upload photos of other people without their explicit permission
• upload illegal, offensive, inappropriate, or deceptive content
• use generated try-on outputs for illegal, deceptive, or harmful purposes
• misrepresent ai-generated try-on images as actual product photos
• interfere with or disrupt the app or connected services
• reverse engineer, decompile, or disassemble the app
• use automated scripts or bots beyond the app's intended functionality

9. fees and payment

mrigai is currently free to use. all features, including virtual try-on and ai chat, are available at no cost. no subscription or in-app purchase is required.

if we introduce paid features in the future, they will be clearly disclosed within the app and will use the platform's standard in-app purchase mechanism where applicable.

10. intellectual property

10.1 our property

the app, including its design, features, code, and content, is owned by mrigai and protected by intellectual property laws.

10.2 third-party content

product images, descriptions, and prices displayed in the app belong to their respective merchants.

11. disclaimer of warranties

the app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

we do not warrant that the app will be uninterrupted, error-free, or that ai-generated try-on results will be accurate. we do not warrant the accuracy, reliability, or availability of any third-party service including google gemini.

12. limitation of liability

to the maximum extent permitted by law, mrigai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, loss of profits, data, or goodwill, or any damages arising from your use of the app, ai-generated outputs, data processing by google gemini or other third-party services, or transactions on third-party platforms.

your use of the app is at your sole risk.

13. indemnification

you agree to indemnify and hold harmless mrigai from any claims, damages, losses, or expenses arising from your use of the app, your violation of these terms, or your violation of any third-party rights.

14. termination

14.1 by you

you may stop using the app at any time by uninstalling it from your device. to request deletion of your data, contact us at aniket@mrigai.com.

14.2 by us

we reserve the right to suspend or terminate your access to the app at any time, without notice, for any reason, including violation of these terms.

15. changes to terms

we may modify these terms at any time. we will notify you of significant changes by updating the "last updated" date. if we make material changes to data sharing practices (including ai data processing), we will provide prominent notice within the app. your continued use of the app after changes constitutes acceptance of the modified terms.

16. governing law

these terms shall be governed by and construed in accordance with the laws of india, without regard to conflict of law principles.

17. dispute resolution

any disputes arising from these terms or your use of the app shall be resolved through:

1. informal resolution: contact us first at aniket@mrigai.com to attempt to resolve the dispute informally
2. arbitration: if informal resolution fails, disputes shall be settled by binding arbitration in accordance with applicable indian arbitration laws

18. severability

if any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. entire agreement

these terms, together with our privacy policy, constitute the entire agreement between you and mrigai regarding the app.
